If you were arrested or detained by the police or another person and you feel their actions were unjustified, is it possible to sue for false arrest? Under some circumstances, it is. Police misconduct does not always require a victim to receive a physical injury or suffer from police brutality. It can also be a case of infringement on one's individual civil rights. Even private citizens have been charged and found guilty of false arrest.

What is False Arrest?
The legal definition of false arrest is the unlawful restraint of a person's liberty without legal authority. This charge cannot only be leveled against police officers, but also private security agents or even individual citizens. In fact, the false arrest charges that most often find their way to court are made against private security agents.
The most important phrase in the definition of false arrest is "without legal authority". Even though some arrests may turn out to be unjustified, if they were made with legal authority, they cannot be classified as false arrests. For instance, it is legal for a police officer to arrest someone during the course of an investigation of a crime. If that suspect is later found innocent, that does not constitute false arrest. The arresting officer had the legal authority to make the arrest.
False arrest charges can be filed against private citizens if they wrongly detain someone by making a citizen's arrest. A citizen's arrest is only legal if that citizen actually witnessed the crime being committed and can positively identify the criminal. They are also required to call the legal authorities immediately to carry out a formal arrest. If the situation does not fit all of those criteria, the arresting citizen could be sued for false arrest.
It is rare for a police officer to actually be charged with false arrest. In order for that to happen, the police office must deliberately detain someone who did not commit a crime. For instance, if an officer were to detain a black shopper for no reason and had no real probable cause, the shopper could initiate a false arrest charge. He could possibly receive punitive damages on the grounds of discrimination if the court decides in favor of the shopper.

In some circumstances when a person was illegally confined, the charge can change to false imprisonment. If someone was illegally detained and transported, it can escalate to a charge of kidnapping. The burden of evidence is on the plaintiff, however, and the charge of false arrest is often difficult to prove.
If you believe you have been a victim of false arrest and want to file charges, you should seek the services of a tort lawyer who will look at the specifics of your case. The lawyer will be able to advise you if you have enough evidence to prove a false arrest charge. Although it is complex, if you can prove your case, you may be eligible to receive punitive damages.

my husband has been false arrested for raping a 4 year old at the time this was spose to have happened he wont around her and the medical shows no physical proof of rape.now the justice system sucks...
my daughters been falsely arrested 4 times because manchester cannot keep their papers right and file against the wrong social security number. Then they screw around for months addind points on a DL for events that never occured...and want to be paid to fix their error..what ignorance and abuse of police power
My son was assured by 1) the local precinct TWICE and 2) the traffic court fines person that his ticket for failure to produce proof of insurance on his car should not have been issued, and was all cleared up (first at the initial officer's precinct and later when he paid the fine which he didn't need to pay but it was either pay the ticket or try to fight the thing in court - I would have fought the thing). Each time he was assured that it was gone, he no longer had worry about it, it was all cleared and was wiped from his record. Tonight he was arrested by a county sheriff's deputy and thrown into jail. The charge? A warrant issued on: Failure to produce proof of insurance! His payment proof was dated one full week BEFORE THE WARRANT WAS ISSUED.
Who is supposed to be entering all this information in the police/court computers????

I went to court for theft under $500.00 and was found guilty. I'll be the first to admit that I was guilty, and I was sentenced to 48 hours public service. I was sentenced on June 15th and was given until December 1st to complete my public service. On October 19th the cops came to my house and arrested me on a warrant for failure to appear. I had to bond out of jail and my next court date was scheduled for October 26th at 8:30 A.M. When I went to court the judge had the same paperwork that I had, saying that I had 48 hours of public service to be finished before December 1st. Other than that the judge couldn't even tell me why I had warrant for my arrest for failure to appear. According to the judge there was no paperwork saying that I had a warrant for my arrest for failure to appear. Guess what happened in court. The judge told me I was free to go, there was nothing else that could be done. So I wasted my time in jail, my money to bond out of jail, and my time in court, because somewhere someone made a mistake. For the people out there that do fail to appear in court, maybe because of a mistake on their part, there will be consequences. But when the courts make mistakes, who do they answer to? Especially if I had to go to jail and bond out because of the courts mistake. Are the courts higher than the law? Does the courts answer to anyone? Am I considered a victim of wrongful arrest, and if so what can I do about it? False arrest is really a big problem that confronts police authorities in the United States. It is indicative of incompetency and corruption.
The First Amendment protects citizens’ rights to free religion, speech, and assembly. This Amendment prevents government workers from retaliating against a person who exercises these freedoms peacefully.

You can file a suit in Civil Court for false arrest and receive punitive damages. That being said, it is difficult to prove even though there was a mistake in your case. It would depend on your proof and the gravity of the impact it had on you. False arrest claims are difficult to prove and rarely won unless, you were physically abused by the authorities. The cost would most likely outweigh the benefit as Lawyers are expensive and this is a case I doubt that a Lawyer would take on a contingency. Since you were found guilty and sentenced to community service, you would have to have a very sympathetic Judge in a Civil Court to win your case for False Arrest. I have a friend that is going through almost the exact same scenario. The Court clerk failed to notate that when he completed his community service he would not have to appear in court. Low and behold he was arrested for Failure To Appear. The Judge saw the error of the Court and dismissed the charge. He was free to go. I have advised him to let it go for the reasons I stated above. If you believe your civil rights were violated, you could try the ACLU to see if they might help you. Other than that, I don’t see you have much recourse unless you want to go for it because of the principle. If you want to do this on your own without a Lawyer, remember this, it is said that, a man who defends himself in court has a fool for a client.

You people have some real opinions. I was arrested in sept on warrent 0001. At 9/22/09 I received a court date of 12/22/09. November 12 of 2009 I was arrested for the same warrent. What do you think I should do?
In my case a had parking tickets to pay($350) and was summarily given a court summon. I plead guilty anyway and set up a payment plan. Made a $300.00 payment to cover a 6 month period hoping to make the remaining payment sometime before then. I received a warrant for my arrest 2months after. Tried working things out to no avail. They denied I made a payment plan and their action was justified. I have papers to prove my position however, not enough funds to complete payment. I am currently awaiting my arrest now. Do I have a legal course should this happen? Feel free to chime in. Thanks
Well I have been a cop for a long time,I have seen a few injustices in my time and I have been the victim myself.
We all have a story and it must be right if I tell it . Most cops enter upon this great adventure not harm people but to save lives and protect kids etc. Things get all balled and sometimes we loose our way when the letter of the law means more than the people we agree to serve. I may be wrong but I have found that compassion is so powerful of a tool and it works. Walk a mile in my shoes, words to live by.
I was detained by the police after a crime had been committed that I was not involved in. I was booked in and placed in a cell for "questioning." I was in the cell for maybe an hour... Is this false arrest? I was never read my rights they just put me in a cell...

A person can be held for up to 72 hours without being charged just for "suspicion/questioning". Rights do not have to be read if you have not been charged with anything. Happened to me! I firmly believe we ALL have LAWS we must abide by. That MUST include our, so called, justice system!
Anytime someone calls the cops the cop always takes their side. They treat the other person like he is guilty until proven innocent. That is wrong. Everything is against the law now. So the cops always claim they have probable cause to arrest someone. Then if they know that they dont and a person gets mad for being falsely accused, they arrest them for disorderly conduct. Then they lie about what really happened. They constantly violate our constitutional rights like the right to remain silent and freedom of speech. Cops are some of the most evil people on earth. Nobody likes them and we are living in a police state.
Our "protections" are just words. The bottom line is that cops will and can get away with anything they want. Unless you are connected and wealthy, your chances of winning in court against a cop is nearly nil. The police system is the most abusive, overlooked, unregulated, imbalanced and screwed up system we have -- and we are at their mercy!

my son doesn't know whether he has a case of false-arrest or not. They said they had a warrant for his arrest for a 10year old ticket. But the info on the ticket was all screwed up. His name was spelled wrong, dob wrong year, eyes, hair, address, phone# all wrong. Only his name and ss# were right. (first name spelled wrong) So he spent the night in jail, had to pay to get veh out of impound. He doesn't want his good record ruined, and wants to be reimbursed for expenses. But maybe this is futile from what is posted here? He has never received a ticket from this police dept, so obviously someone else used his name, but why was their ID not verified?
I recently went to the Boardwalk( a common outside dating scene/ shoppin center) with a girl I was meeting for the first time. It was still daylight, we stopped in front of a restaurant while she waited for her ride to come and we kissed. People passed us by, and awww on how sweet it looked. Suddenly the boardwalk police comes by and asks us for id, we present it, shocked, and he jokes that some people thought the girl was revealing her parts since she wore black pants and shes black and that we were having sex. We laughed with the cop and he left after giving us back our id's. We sat and talked maybe 5 more minutes and suddenly the cop returned with 6 more and this time they were rude and insisted that we had sex. Feeling disrespected and unheard, I pulled out my phone to call a lawyer I knew. The cop handled me roughly, my phone dropped and put me and her in handcuffs. We were charged with a felony viscinity and we feel we have been done wrong. First date turned into hell date when we were forced to spend the night in prison and be transferred to the county to dress out for another day. Both our parents bailed us out. We both our college students, we don't get in trouble. Now they insisted that they didn't have cameras when we told them that it will all be solved if they check them, can we file a case because of this...somebody please help me...
on friday night i was suuround by 27 police afficers from all different counties in florida, and all with gun draw on me..they handcuffed me and accused me of robbery.
i was told they were looking for awhite female in a black suv. the owner of the store came to the place were i was handcuffed and stated i was not therobber.

i called the cops and i got arrested!! The res. manager didnt like me, and i was moving out and he knew it but i was paid up 2 full months of rent which he didnt know hes only a res. manager he thought he was god, any way i got arrested because the officers didnt want to listen to me they took his side and kept verbally abusing me when i was trying to explain that i lived there and im paid up 2 months officer kept saying to shut the hell up! then the 3rd time he just handcuffed me i asked why he didnt even say why then he didnt even read me my rights his captain wasnt even on the scence and their were 3 rookies! they should learn the law before even attempting to do an arrest, its a power trip, so now i went to court and req a lawyer because they lied about the whole thing on the report they said i was trespassing, and the officer said they had a paper for my arrest in court they did not! They didnt even give me a paper and when i questioned the officer he said ur a liar i did give it to you he couldnt even answer my questions. and hes not going to investigate my window being smashed its a whole corrupted issue with them, i asked him why and he said you didnt tell me that when the incident occured i said how could i when i had to shut up and i was handcuffed no one wanted me to speak. the legal system is corrupt and i think the officers should know their laws and stop misusing their authority. So now the criminal gets away and the victom has to go to court, and pay for my damage my self, and i suffer daily from the incident. I dont feel safe any more I should have just confront the guy my self, i probably would have caught him myself. I hate to say it but i will not call them ever again, not in this county thats for sure. I feel safer with out officers, at least i would get less grief.
My son was arrested and charged with armed robbery, when the arresting detectives told me they KNOW he was not involved. the witness described the 4 men who robbed him as black. My son is white. He has an alibi, but still....sits in the detention center.

I witnessed people running away from a stolen car in pinehills and when the cops showed up, I tried to ask what was going on and that I had seen two men and a woman run away from the car, they told me to go inside this is a classified G-57 which is a term from the movie Rush Hour,that is one of the reasons why people don't trust cops anymore and why they can't solve cases.
I was arrested this week while i was waiting in a friends car to get towed. someone in the neighborhood called the police based on a suspicious activity thought(waiting for the tow truck). The police got there and asked my friend and I to get out of the car. They searched the car and found there was aerosol cans. I explained to the officer the intended use of the cans. He kept searching the car and simply told me "I DONT BELIEVE YOU I'M GOING TO ARREST YOU." I am 18 so there was no crime being broken there and before he took me to the jail he told me he was arresting me because he "THOUGHT" I was "GOING" to do some sort of vandalism. Was this right? could he have done that to me and took me to jail?

i was arrested for simple assault in the beginning of oct. The police thought i hit my wife but it was the lady next door. My wife told the police repeatadly that i didnt hit her but it didnt matter. My son was falsely charged with assaulting a police officer. The officer told me at the police station that his chief wanted him to press assault charges on my son. The officer said he didn't assault him. The chief told him to tell the magistrate what happened when he did she said she wouldn't let those charges fly because it was not assault. He was charged with drunk in public and didn't listen and after putting him in the cop car his wife fell to the ground and he started banging on the window trying to get someone to help her but they wouldn't listen to him until the window broke. He was charged with destroying property. The officer didn't show up for the court and the Judge allowed my son to get help for alcohol issues. The prosecutor told me my son attacked the officer and grabbed the officer by the neck. I told him I don't know where he gets his information but he had it wrong. About a month went by and my son was recharged and they added assaulting a police officer. The officer came by my house four or five times and told my family and myself my son never assaulted him. The lawyer told us the officer backed his self into a corner by talking to us and in order to keep his job he had to do what the prosecutor wanted and that was to lie and say my son assaulted him. We spent every penney we had and the two seperate lawyers we got didn't do or say one thing to help my son it was like they were working for the prosecution instead on my son. My son spent six months in jail for a crime he didnt' commit. Now he has a felony charge on his record. This isn't the only time this crooked kind of stuff happened to him. There is a lot more, but this is the latest. I've written everyone I could think of and no one will help.

On Thanksgiving Eve. I was pulled over on my way home from a band gig at roughly 2:30 AM. Obviously a DUI check. I do not drink and drive so I wasn't worried about anything at all. The Police had followed me for about 3 miles from where I left from and finallly pulled me over a few blocks from home. After seeing I wasn't intoxicated the officer ran my license. A warrent came up from a minor charge I had 3 yrs ago inwhich I completed a class and 30 hrs community svc. Somehow something had happened. After sitting in the county jail from Wed. eve. till Monday eve. We found out that the prosecutor in the case when looking at my file (3 years ago) had overlooked something and then also failed to send me or my lawyer any notification of a hearing of any sorts. I was incarsarated for 6 days and it was pure hell. I believe I have a tort claim. Any comments or suggestions?

I was reading all above whosoever people are really innocent..That what was happening to my two sons..My sons were walking on the street from the store and went back home..Five police Officers were false arrested to them..They said that they were prosecution cause police officer said that my sons had been Armed Robbery Firearm,Aggraveted Battery and Deadly Weapon..That was not true..My two sons really innocent and not have any weapons and also not even one touch any body period..The police Officers were putting my two sons in Jails.I do remember of the pastyear ago..one of friend mine and he was jail for 7 yrs and all Police Officer are liar and that was accused him to rape of his daug and his daugh was in the hospital and the doctors said no rape..Why the jugde and Police officer kept his in cell for long time? In september 2010 i called the police because my husband hit me, threatened me and tried to kill me. There was a gun in the house. I called the police and told them that there was a gun in the house and that my husband was going to kill me. They arrived retrieved the gun and arrested me, telling me that the operator told them that a woman was armed at my address. Where did they get that from? No one was armed, still i was arrested and spent 18 hours in jail and my husband is still free. There have been several attempts against my life and have been escorted out of my house twice due to brake-ins in the middle of the night. Some police officers told me to get out of the house because no one comes to a house at that time of the night to just scare someone, the intention was to kill me, yet my husband is still out there running the streets. He put sugar in my tank of my cars and the police simply called him to ask him if he did it. Really? that is what they did, still i am charged with two felonies and going to court for those charges because the state is charging me. Unbelievable that the police did this, I know that i have a suit and i will not stop until i get paid. I have lost my job due to this matter and my reputation is ruined. What can i do?
To wife: I am sorry that you are going through that. I am going through the same except that in my case the police has told my husband to testify against me to validate my arrest. If my husband does not testify against me then he will be charged with domestic abuse since i have already proven it in court that he abused me the night of my arrest. So he is being pressured to testify or else he gets charged so to justify them arresting me and damaging my reputation. I have spoken with several lawyers and they are certain that there is no case even if my husband testifies but that is not up to them or me, its the judge who makes the decision. I have been harassed, threatened, abused, embarrassed, i lost my job, i lost my government clearance and my neighbors are asking me to move due to all the mess with the police coming to my house every other day and i don't know what to do. Hey, I might as well add my story of false arrest. I am an extremely successful engineer, make about $200k yearly and used to have open ended government contract to help USA develop weapons. But a rookie cop ended that for me one week prior to her wedding (wonder where her mind was). Felon attacked me with 2X4, and I defended myself with tire tool from my truck. I workout regularly, so felon got a facefull of tire tool, then dropped his 2X4 and called cops claiming to be victim. I had already started my drive home, still thinking about what to do about it, when I get pulled over and arrested. I had literally seconds to explain my side, which was completely disregarded. Felon had changed location of events to his workplace, told police I was breaking into cars (car/radio theft pays much better than engineering development?), and of course there was no 2X4 at his workplace. I got booked for felony assault with deadly weapon and misdemeanor assault. State attorney immediately drops felony (guess they recognized felon's name), but I still have to answer for the misd stuff... Methinks that case goes nowhere either, cause only witness is known violent felon. Meanwhile, my boss terminates contract due to felony arrest (hes government, can't say I blame him). Thanks, PD, for screwing up my life/business. I guess its all OK since charges dropped??? Not at all! Police and court system need to be held accountable for their mistakes just like the rest of us! System is BROKE and must change!!

my brother is currently doing time for a charge called giving false information to a police officer. They currently have him under another name when he attempted to show his ID to the officer he stated under sworn testimony that it is false. Its actually him, the person whos name they have him under is my brother and he is unable to prove who he is cuz the police dont believe him. Is this considered false arrest?
First let me explain I have well documented complex PTSD . It was raining in 2007 january . I turned into my subdivision and my light wieght volkswagan slided into a pole . All of a sudden there was a pct 4 sheriff behind me with a thick neck and shoulders telling me to get out of the car . Comming toward me very aggresive I felt myself losing it and got very quiet he reminded of me of my Dad exmarine thick neck big shoulders screaming.Usually my Father beat me to a pulp . Suddenly there were all these cops half of them big bruisers . They gave I don't know how many breathelyzers all I had was .01 I had had a beer about an hour ago . This big bruit of an officer handcuffed me in front of my nieghbors . I was frozen in Complex PTSD and couldn't even talk . They took me to Cypress substation handcuffed like an animal to a steal bench . With other poor souls there. Then they drug tested me , I was negative . I had hit my head which didn't help . Then they filmed me during a sobriety test I kept comming out of the Complex PTSD and asking them don't they understand what PTSD is and that I needed to go to the hospital . The police man doing the sobriety test was the only one who didn't yell at me . I ask him since I am not intoxicated and negative for drugs whats going to happen to me . He said I was going to go home . Then the big mean bruit of an officer hancuffed me back to the steal bench seemed like hours then arrested me on dui with a .01 alcohol and negative drugs. Took me to houston jail . I was having a hard time with flash backs from the past and it was difficult to maintain . The officer at the jail lied and put on his report I was a .08 So somehow after being brutilized talked to like a dog and cussed at in custody I developed a .01 to a .08 . definet lie . I called my husband and told them they think I'm drunk and to post bond . While spending 12 hr in lock up there was a young looked like a short hispanic woman harrasing me the whole time trying to get me to fight . Short thugs always want to challenge tall people . So I just sat up straight looked her in the eye and said nothing . Which scared her . Then after 12 hours I was released into the worst part of town begging on the street for a quauter to call my husband .The woman that was hassling me was waiting for the bus and more of her friends gathered .This kind homeless man about 6'6" with dread lock with scizophrenia called me over . He had a shopping cart and kind eyes . He protected me . Then he let the store owners open the door and gave me a quarter to call my husband . The system had faiLed this nice man and many other who have to use alcohol and drugs to relieve ther terrible symptoms . My career has been ruined I am listed as a convicted criminal even though my case was dismissed they still have the arrest record on file and the DPS made a mistake and has listed me as a convicted criminal MY carreer could be ruined forever I am an a RN and a dam fine one . I am working for ten dollars less an hour and no benifits .I am all over the internet with these background companies as a convicted criminal . The DPS 1st posted this then every backgroud company posted this . I don't exspect the background companies to keep up with current events .I have a Lawyer exspunging my arrest since it was dismissed and a violation of my civil rights .I have gotten better with my Complex PTSD and the time limit on getting my money my reputation as an RN . The possibilitly that my livelyhood will be gone come November when I come up for review at work and this may be posted on thier backgroud check company . MY liberties have been taken away already I am working with no benifits and 10.00$ less an hour . I will always be listed as a convicted criminal because of this arrest and may not even get a job at Mcdonalds . I have already lost so much in my lack of pay trying to find a nursing agency who won't dig so hard in my past .I'm so afraid of cops at 14yrs old I was raped and strangled ,when my parents finally stopped hiding and called the cops due to my sister and I screaming she saw the marks around my neck . He was still in the house hiding and the cops spent 45min explaining to my parents these girls invite them in then change thier mind . My parents scapegoated me and abused me in everyway ,they were listening and glaring at me . I was a virgin until that rape . The police entered my room found stacks of towel with all kinds of different sized knives and scissors,all different kind of size needles already threaded .He had spent a long time around my mothers sewing machine . Then all of a sudden other cop cars were called and they caught him in the niehbors gararge .From then on my father addressed me as whore or slut . the cops are not my protectors they are my perps.
I was arrested about two weeks ago and I believe that it was wrong (false Arrest) I got in an argument with my husband and it got violent on his part I ended up running down the street barefoot to get out of the situation. I had a sprained thumb, A big red eye scratches on my forehead, rug burns on my elbow from getting thrown into the floor, as well as bruses. I just wanted to get out of there and get back home. I got a ride to the local gas station and when I got in there I got yelled at because my dog had followed me so I had her in my arms. Being totally traumatauized I was crying and upset not knowing what to do and where to go after I got yelled at for bring the dog in to the store. I left and tried to find a ride out of town to get to my father. I got a ride from a man that was headed that way (closer to home) as we were going up the hill and out of town the lights came after us apparently someone had called law enforcement because I was crying and distraught (walefare check is what the computer said) anyuway.... the officer asked me what happened and I told him that my husband and I had gotten into an altercation and he got violent they asked who he was and I told them. At first the officer had me filling out a victims packet as I was doing this I heard him on his phone saying "but she dont look like the aggressor sir" after this he took me back to where my husband was and went inside he came out with a different attitude towards me and asked me how a mirror got broken I told him I did not break the mirror. (I did know it was broken cause as I was getting tossed around I was in fear that I was gonna get thrown into the broken glass) He told me that I had been lying to him the whole time. He told me that " In his experence the aggressor always has marks on him/her (isnt this backwards?) he said that because my husband did not have any cuts on his hands or marks on him that he did not break the mirror (mind you I did not have any cuts on me either) just a sctatch on my forehead from him (husband) restraining me :( I was then arrested for criminal damage to property and nothing happened to my husband they just let him go and hauled me off. :( whats worse is that in his report he states that he (officer) does not know how I got all the marks on me that I had said that my husband has done. I am completly trauamatized over all of this not only the abuse but the second victimization by being blamed for all this. I can not sleep nor have I ate a decient meal in weeks I have nightmares about all of it and worst of all im still scared because of the unjustice that has occured, An I am considerd the aggressor and he the victim. It is just wrong by all means. I even have had individual counseling once a week to help me to cope with this. I am so confused I did not fight back for fear of getting into trouble and got hurt but I still got blamed. any suggestions for me? I have to admit I am even scared about posting this for fear that they will get mad and find something else to come after me for. :( If they arrested me wrongfully the first time whats to say that they wont do it again. I am completly confused about this and I want get it out there. What do I do but still be able to protect my self from further unjust actions.

The was an ATF,US MARSHALL'S AND LOCAL POLICE sting that involved over 1300 arrest,if you google (602 exchange sting) they will tell you what sounds good but what they left out is that they literally made criminals.they charged people with drugs,and firearms and said they fought rapist and ex felons and ect...They knowingly tested the wrong drugs to convict people because the drugs brought to them was from their confidentail informants with out them knowing about it,so alot of charges are being dropped and their might be a class action lawsuit against them.its a long story behind it bt that the main point,corrupt law enforcement to make their rank/promotions and a higher pay raise and be called heros,for what? I am very distraught after reading all of these posts on false arrests. All I can say is I hope all of you get restitution from the County where the rotten cops live and work who abuse their power to harass innocent victims. I too am a victim of being falsely accused by my neighbor. I was charged with a Felony Malicious Injury to Property after I hired an individual to trim the hedge that borders our property. I own the hedge. It is costing me a lot of money to pursue this. I keep the faith and stay strong as all of you must do to succeed. I am suing the neighbor for $5 Million and the County for $30 million. I have been diligent in winning my own case by investigating every lead and doing internet searches for any clues that will help my case. All of you must not depend on anyone but yourselves to fight these injustices. Cops think they are immune, but they are not above the law. Prove your case and stay sane. Make anyone listen. The State Attorney General must listen to you...it is his job. Call the ACLU, tell them your story. Call your senator...make him listen. Tell your story in your own words to any newspaper. Tell your story to major news sources. DO NOT give up. It will take everything you have to fight, but it will be worth it in the end. I was arrested after my husband cut me and kidnapped my children. I tried to get my kids back from him that i have custody of. he cut me and shut his door. I opened it because it was broken into months again and would lock. after he attacked me for coming into his house i went and got a protection order from a judge and keep going to his house with them to serve him and get my kids. He told a dectective a complete different story then his "witness" and instead of letting me come in for questioning they charged me with aggravated burlgery and assault when i had defensive wounds and he had offensive wound where he cut himself trying to cut me. the dective said he arrested me because i didnt call him. i didnt know he existed! i lost my house and all my belongings. I sent 40 days and jail and now my ex hub is on the run from prejury and still has my kids. there has to be something i can do.
I was taken to jail for a crime that never happen never was charged for the crime I was arrested for but was charged for giving the pigs my id and was giving a felony . I was let go with no charges. i walked into a police station for questioning for a crime, that i not only did not commit, but had proof, and witnesses of my innocence. i walked in willing, knowing of my innocence, at which time, i was hand-cuffed, arrested and charged for this crime. i was never read my rights, nor given a chance to show evidence on my behalf. i was then locked in county jail, only to be released 2 days later due to the prosocuting attorny dropping all charges. is there anything lawful in this, and can i do anything against this arresting detective?

A part of me smiles when a cop gets killed, a judge dies, and an FBI agent is killed, or even a fireman loses his/her life. It makes me wonder how it is that EVERY cop or fire fighter that dies is/was a hero. This whole system is designed to be self supporting. They all smile and shake each others hands for having gotten into such an expensive system to fight. Poor people haven't got a chance. We place trust in these people, yet the vast majority of them are just as bad as the crooks they arrest, try, and/or even murder. I call them a necessary evil.
I personally knew a person who was writing a tell all book about the corruption in the fire dept. You see when they get you out of your burning house, they're in there busy stealing your stuff. Ya see, if they steal enough stuff, they let your house burn to the ground, that way (you think) you've lost everything. Tracibility is gone. The way they encouraged this guy to stop writing his book? They ran right over top of him with a cadillac. Miraculusly (never been a good speller) he survived after being in intensive care and 2-3 years of convulesence. The book never came out, but I did see the design jacket for the cover of the planned book. There is a differnece between the law and the "mob." Husband says it's a good idea to drink more since I'm home. Totally shook up I start slamming beer. Cops show up. Now I'm sillier than ever drunk. Lie to police tell them I wasn't driving. Arrest me for OWI, Disorderly, Obstructing.
Crazy stalker hoarder terrorizing abusive new neighbor decides to call same police same nights repeatedly. Fill cops heads with lies about me. Three weeks later psycho hoarder who happens to be related to someone at the sheriff's dept. calls police on me. She and another big fat liar (who didn't want to be arrested herself) make up lies to have me arrested. Police come arrest me again for disorderly. DA adds obstructing charge since cops reports are full of lies and even though I told the truth this time I've been known from the OWI to be a liar.
Take plea deal or take it to trial? I took plea deal and I believe that was the biggest mistake I made. It's very overwhelming and draining for innocent people. After a certain point you just want to take the bad plea deal and move on with your life. They give you so many charges that when they drop a couple you're supposed to feel good about it even though you've been totally violated and your side of the story has never been heard. Then there's a feeling of relief for having it "over" but it impacts your life forever. My life has been destroyed & wasted by trailer trash losers who have no life and nothing better to do than totally mess up other people's lives. It all depends on who calls the cops first.

On my friends front steps Playing guitar and hanging out at 12:35AM Cop came up the One way street and stopped infornt of his house, looked at us proceeded. gangbangers are known to roam around that area so me and a friend needed to get home. we said our goodbyes and proceeded to walk through our friends back yard to get to 7 11 (he lives exactly behind the store, they share the same alley) to break a 5 dollar bill for bus fare. we're walking to 7 eleven and the police randomly stopped us saying that we had broken someones windshield and spray painted their car.we were told to put our hand on the hood and we were cuffed together right away they searched us,during that time 5 squad cars pulled up 1 of the squad cars was the SGT. he stepped out the vehicle and told the officer if this was the only reason they called for back up, he hopped back in his car and left . they looked up my record and found out that i was arrested for possession of a marker when i was 16.(THIS IS WHEN THEY MADE UP THIS BULL SHIT STORY) 5 minutes passed and we were both hand cuffed separately and and put into the back of the squad car without them reading us our miranda rights which is illegal.(WE STILL DIDNT KNOW WHAT WAS HAPPENING WE WERE'NT NOTIFIED YET) one of the officers came to the door and told us they were going to let us go any minute. the two officers got in the car and started to drive away. We were falsely accused of doing something we didnt do and we were abducted off the street without them telling us what we did until we were in the car on the way to the station which is against the law because before putting cuffs on us they were supposed to read us our rights and tell why we were being arrested. Their supposed to do this when an officer is accusing us based on a witnesses story and not his own. Their were witnesses that CLAIM they saw us and said they they watched or seen us throw a rock with is complete bull shit, also the car was Spray Painted with the letters "SUR" we were a block down from where this "incident" took place.... have court DEC 29.2011 WE WERE CHARGED WITH CRIMINAL DAMAGE!. I feel for all of these people that were falsely arrested. i was also falsely arrested after visiting with my mother for the weekend. My mother has parkinsons and dementia and on the 17th of september she had a episode of very erratic behavior that i had never seen before at 1am that morning so i called 911 for some help to come and while i was waiting for the help my mother slipped past me in her pjs to go out the front door. She lives in south central LA . not a good place to be wondering at 1am in your pjs and 71 years old. so i grabbed her arm to keep her there until the paramedics came. when they finally got there , there were about 3 paramedics and about 6 police. they talked my mother into going to the hospital after she slapped a person standing near while they were talking to her.At no time did anyone say i did anything to my mother because i didn't. She went to Centenila Hospital and when i arrived no one would talk to me or allow me to see my mother. But the hospital charged me with elderly abuse against my own mother ,the one person i love more than anyone in this world and called the sheriff and had me arrested . I stayed in jail for five days before the DA saw the info and totally rejected the charge. This was severe defamation of my character because first i am innocent and i have taken care of the elderly and children since i was 15 years old and the jobs i have today consist of the same type of work.Once they finger printed me and booked me it went straight to the trustline system which automatically picked it up. Now i am suspened from my job for no reason other than the incompetence and negligence of the hospital and the sheriffs to investigate a situation before they accuse. Now the hospital is saying they were not at fault because the sheriff should have investigated before arresting me but i say they are at fault as well because if they wanted to know what happened to my mother they should have asked me . I was the only other person there at the time. I have seeked legal counsel since all of this has happened and I am appauled at the response of attorneys defending civil rights violations because they no longer have morals or principals when it comes to our civils rights. They only want you bleeding, shot , boken bones, beat up by the police, and never mind the fact that they have destroyed my life by placing something so awful and discussing on my blimish free record . Where does it say in the 4th amendment that you can only be violated if you were shot , bleeding with broken bones in order to be defended and protected. We have become an immoral society that base importance of our civil rights on the dollar value only not the morality or the principal and this is very sad and it will not change until we get some attorneys with morals and principals again until than we are all unprotected and our civil rights don't mean a damn thing.

So I was charged with driving under a suspended licenseAND FAILURE TO APPEAR.! On 06/10/2011 I paid someone to drive me to St.Joseph, mich.where I was promptly cuffed and impisioned for 25 days !! BECAUSE I DID NOT HAVE $1,000 CASH FOR BOND !! ( each count was $5,000 bond at 10% so I needed 500.00 for each count )
On the 22 day the charges were dropped but I stayed in jail until 10/31/2011,so so I would not have to bail out and lose my money.! Then on the 31st I pled guilt to the no show charge so I could be released.and got out on 01/31/2011, ALL TOGETHER I'VE LOST 28 DAYS OF MY LIFE FOR CHARGES THAT THE COUNTY OF BERRIEN,MICH."HAD NO WAY OF "NOT KNOWING"!! THE CHARGES AGAINST ME" WERE A LIE !!

I was arrested and police concealed evidence I gave them PRIOR to my arrest from the DA's office which showed I was innocent. Its video taped and eamil evidence police concealed. The warrant was for a then incarcerated woman who had lived in the house 3 years prior ro my buying it. When I offered my id to the investigator to show I was not that person nor did I know them, he refused to look at it and told me to "take it up with the judge" I was stayed in jail for 18 days under a $100,000.00 bond.All charges were dismissed and expunged..WHILE IN POLICE CUSTODY MY HOME WAS LEFT OPEN, ROBBED, MY CAR WAS STOLEN FROM MY DRIVEWAY,WORST OF ALL MY EX FILED FOR IMMEDIATE CUSTODY OF OUR DAUGHTER AND WAS GRANTED (AFTER MY RELEASE) BASE ON THE TESTIMONY OF THE CRIMINAL INVESTIGATOR IN CHARGE OF THE EXPUNGED ARREST. I HAVE NO CRIMINAL RECORD, NOT JUVINILE NOR ADULT. I LOST EVERYTHING IMPORTANT TO ME IN ONE FELL SWOOOP AND FEEL THE AUTHORITIES ARE RESPONSIBLE FOR COMPENSATION. When I offered my id to the investigator to show I was not that person nor did I know them, he refused to look at it and told me to "take it up with the judge" I was stayed in jail for 18 days under a $100,000.00 bond.All charges were dismissed and expunged..WHILE IN POLICE CUSTODY MY HOME WAS LEFT OPEN, ROBBED, MY CAR WAS STOLEN FROM MY DRIVEWAY,WORST OF ALL MY EX FILED FOR IMMEDIATE CUSTODY OF OUR DAUGHTER AND WAS GRANTED (AFTER MY RELEASE) BASE ON THE TESTIMONY OF THE CRIMINAL INVESTIGATOR IN CHARGE OF THE EXPUNGED ARREST. I HAVE NO CRIMINAL RECORD, NOT JUVINILE NOR ADULT. I LOST EVERYTHING IMPORTANT TO ME IN ONE FELL SWOOOP AND FEEL THE AUTHORITIES ARE RESPONSIBLE FOR COMPENSATION. AT THE TIME OF THE ARREST I WAS A SINGLE MOTHER OF 1 HAPPY ,HEALTHY, INTELLIGENT DAUGHTER, PAYED ALL MY OWN BILLS, WAS BUYING A NICE HOME, OWNED 2 CARS,AND WAS IN THE MIDDLE OF A DISABILITY SUIT( which I have won ).I WANT MY DAUGHTER HOME AND COMPENSATION FOR MY LOSSES, THE UNDUE STRESS PUT UPON MYSELF AND DAUGHTER, AS WELL AS DEFAMATION OF MY CHARACTER. WHERE DO I BEGIN TO FILE SUCH A CLAIM???

i have was arrested by a security guard i have a clean crimal back. i have been having problems with the security guard company and have made complaints to the company for about almost to year any on the night of the false arrest i was walking around and i noticed the office lights on of are apt office which was all my information it my mom was with me any that was weriod beucase the office close at 5pm and it was about 4 am which the guards leave a 3 am any way long story short i was wait till i seen who walk out of the managers office at about 4 am then i seen it was the security i filmed it with my camcorder any way then seen didn't say any thing so i filmed his license plate because i wanted to get a oder of protection agaist him any way after when he seen me film his plates he got mad and said your film my car and he came over to me really fast then i said basically leave me alone then he said no i'm not going to leave you alone then he began hitting me over and over again then he grabed my left hand really hard then he hand cuffed me and the police didn't do any thing to him i really need a lawyer but not sure what kinda i need and also the guard still works here so i can't go out side any more at night any one have any information please commets below thanks alos i for got to say i'm under the ada for a learning disablity to thanks
I came back after 8 months being abroad on business. 25 minutes after I got home, not even finished my tea, my wife (now we divorced) called police citing that I did not inform her after being left for 8 months. The police arrest me for disturbance. My wife holds the title of the house, but we were not divorced then. My ex-wife later that night obtained a court court order from restraining me from entering the house by lie to the judge that we were divorced. Is it a false arrest?
I have been false arrested in DC Superior court when I return to a court case. The US Marshall step me back into the court cell inside a courtroom when the judge was next door, because the court clerk asked me to sign paper work without allowing me to read and I said no and want back inside the court room. The next thing that happened a us marshall asked me to step out o the of courtroom only to be locked up.
I know somebody that was arrested for DUI drug and still in high school they serched her car with dogs and did not find any drugs but still took her to the hospital to take blood and urine she spent 14 hours and they said she would stay two months but her parents got her out when the drug test came back it was clean no drugs and still got charged a 70.00 dallar court coast he mom ask the judge what about the time she done in jail for a crime she did not comment they told her mom we don't have to have a reason to arrest anybody
If not sue what can I do ? After a few drinks at a family holiday party I became depressed and tried to cut myself, my daughter grabbed the knife and got cut, the neighbors heard the comotion and the police were called I was arrested and sat in jail for 5 days on charges I didnt commit 2nd degree asualt and am being told now by my lawyer we are probably over the next several months get them dismissed. This is after my days in jail jeopardizing my job my sanity and lots of money. The report states that I grabbed a kitchen knife and turned and struck my daughter causing injuey, she is ready to testify in court that that is inaccurate and the at the cop was in a bad mood making negative statement like you cant let her get away with this etc., additionally she was treated in the ER where the ER records and her intake records also state the truth what happened. I do not want this just dismissed, I want the records his lies removed, it has cost me time from my job and the false statement on the arrest record dismissed or not will prevent me from keeping my career or over 20 years even if it is dismissed since it is on my record. What can I do, my lawyer got me out on a gatutiy bond and we are not in a big town so I am afraid him helping get out of that horrible place (which is another story) may have been incomplete. I am out for the time being and a court date is set to dismiss charges if I yes I comply with therapy - since the so called victim (oops not me trying to commit suicide) but my daughter who grabbed the knife is family they want to make sure there is no domestic problems.....I do not understand how an officer can write what he wants and have such a horrible impact on my life I SWEAR I am telling the truth about this and again I have testimony and ER documents to show what happened - any advice?
I was arrested and spent nearly 8 months in jail before charges were dismissed. It turns out critical evidence to prove I was the victim and that I am on video tape giving ot police was never turned over to the DA. Also a witness for me, who is a cop himself, was never contacted or invterviewed by police to verify my accuser was lying. Anything there for me to complain about?
I live in florida in seminole county. I was taken to jail for a violation of an injunction along with a no bond status. So i filed a 33 day motion. My 33 day comes and no one pursued the charge and i get ror on 10-28-10. So im ready to go home! Let me add, i also had another pending charge with grand theft but i had $100 bond for this one so my friend was already at the bondsman so that didnt matter at the timed. Ok so here is where it gets good, its now two or three months later and i still have NOT been released! All this time everyday, 50 different bondsmen, calls to the jail and courts my friend is sounding like a broken record telling them they made a big mistake. Everyone is telling him the same story...sorry it says he has no bond on the violation of injunction. Lol of course we know its bull$**? because that was droped and i was released on 10-28-10! Finally one bondsman freely spends his whole day try to help. Then later that night he pulled out deep in the computer system that we were right! He calls and tells the jail to release me and inform them they never changed my case info in their system and they have been holding me for almost three months on no bond status when i did have a $100 bond! And he and my good friend would have had me out.
We would like to sue for those months i rotted in there. And bondsman, friends and family r willing to testify or help in any way. I lost my home, jobs, two vehicles, and most of all my piece of mind. Is this possible or a good case in any way to prove or win in court? what should do? I need all the help, info, contacts, ideas.. Anything is helpful.

My girlfriends Mother (who did not want us together) took a lovers quarel and turned it into forced entry, strangeling her daughter and burgerly. After 5 days in jail for "false arrest" (she blew everything out of preportion and made it appear I was attacking her daughter) I had to go without very important medicines (among them Feteynol)and I was forced to be subject to withdrawls from the medicines, mistreatment and total embarrassement when arrested. I'll let you guys know the outcome after court. Good luck with your cases. Funny thing. While in jail I tried to explain to fellow inmates that I was innocent. One inmate said, "You know what everyone encarserated says they are not guilty! Damn!

I have a friend who was acused of having a sexual relationship with a 14 yr old who in the past had acussed others of the same. One month after my friend was charged there was another male charged with the same.My friends attorney pushed him into taking a plea to a lesser included charge. He never would have served a day if this so called attorney would have used the evidence he had, instead he sat on it and let his client pay the price. My husband and his friend were over at the victims place. When the victim started yelling at me over his cell phone my husband beat him. While beating him, he threw the cell phone to his friend to call me back and let me know what was happening. The victim threw in punches too at my husband. When they left, the other friend of my husbands cut the phone cord and took the victims cell phone. My husband came home. The victim called me and said he wanted his phone back. I asked my husband about it. He said he didn't have it. So I called his friend. His friend said he don't have it anymore, that he threw it. So I asked where and then I went to find it. I found most of it but not all of it. When the police arrived I gave them the cell phone. Told the detective my story and that the victim called me later that evening and the next night and told me that Bill did not take it that the other guy did. Now my husband is in jail for robbery, not assault. And his friend walks? It is pure B.S. What can I do about this?
Not shooting the messenger of course, but phrases like-- "It is rare for a police officer to actually be charged with false arrest." and "Even though some arrests may turn out to be unjustified, if they were made with legal authority, they cannot be classified as false arrests."--- are disgusting.
As a victim of what I certainly call a FALSE ARREST and ten day incarceration, resulting in job loss, followed by 13 months of court appearances and TASC (which can only be described as a 'probation for innocent people' requiring I be on time every month and clean as a whistle, lest they lock me back up and seize the $1,500 it cost me to be free, while the city forbade me from returning to MY home, lined with the constant threat of certain prison time, all without a shred of evidence other than an alleged statement from a person they couldn't seem to find---------I would say that there are few crimes greater than abuse of power and few violations more damaging than being accused of something you did not do.
I was charged with one count of 475(c) and I went to court I go back to court next month but today I got a warrent in thr mail for the same charge in sacramento can they charge me twice
It is amazing at how this country has fallen in the standards of what were once our finest. There was a day when an officer would ask, “Should I make an arrest, not, can I make an arrest?” Today it seems every cop is on an ego boosting steroid. They are public employees who should lose their jobs, lose their pensions and be kicked to the curb of the real world when they make a breech of the law. Time to stop watching so much TV and remember you are not the hero you think you are. You are doing a job that you chose to do and get paid well for doing. Do it right or get out!
A 17 yr old victim has been falsely arrested. He had visited an 18 yr old friend and been there for 2 days when police arrive and arrest both males. The 18 yr old had stolen a car and the 17 yr old had no knowledge of this crime. 6 weeks later both are still in jail. Can he sue the arresting officer's bond in a civil capacity and the county's bond for false arres? and detainment?

previously falsely arressed and incarcerated for 30 days in county jail. Contact resulted when i called em 911 for medical; instead several offericers appeared and kicked in my door aiming gunds attaccking me ;requiring hospital care by the sherrif dept prior to jail admittence. The whole feasico resulted in the township offering no contest and release after 30 days in their "hotel".
